Right to appeal

An applicant has a right to appeal a decision on recognition taken by the competent authority which s one of the main principles of the Lisbon Convention. The revision and appeal of the results of the recognition procedure is provided for by the procedures for recognition of foreign educational documents.

In the event of applicant's disagreement with the results of the recognition procedure, the applicant may submit a well-founded petition for review together with additional documents in support of passing the program and receiving qualification to the competent authority conducted the recognition procedure. within three months from the date of registration of the notice of refusal to recognize a foreign educational document, or from the date of registration of the Certificate in the electronic logbook within three months from the date of registration of the notice of refusal to recognize a foreign educational document, or from the date of registration of the Certificate in the electronic logbook, with statement on review of the case and provide additional documents for the program and the qualification received. Such petition shall be submitted within three months from the date of registration of the notice of refusal to recognize a foreign educational document, or from the date of registration of the Certificate in electronic registry. In this case, the competent authority reviews all documents submitted by the applicant and conduct their research, as a result of which the previous decision on recognition or refusal of recognition may be revised.

If the Applicant is  not satisfied with the result of reviewing the case at the competent authority (higher education institution), he/she may apply to review the case to the MES. The application is accompanied by the documents noted in the section  Appeal of the results of the recognition procedure. Based on the results of consideration of the submitted documents, the MES makes a decision on recognition. Based on that decision the applicant is issued a certificate or the answer to refuse to recognize a foreign educational document of which. The applicant receives a notice stating the grounds for making such a decision.

Besides taking an appeal from the results of the recognition procedure, a higher educational institution may review the decision of the Ministry of Education and Science.

If the holder of a foreign educational document, that receives the Certificate of recognition of the MES, obtains a permit to study, the higher educational institution may review the results of the recognition procedure, but solely towards more favorable results for the student. In this case, the commission of the higher education institution carries out its own analysis taking into account the decision of the Ministry of Education and Science and the requirements of that higher educational institution for a certain program and skills of the potential student and takes the final recognition decision.
